Terms of Service

You must be at least 18 years old and legally able to enter into contracts to use the Services. You may not use the Services where they are prohibited by the law of your state, country or other jurisdiction, and it is your responsibility to know whether that is the case. You agree to provide accurate registration and shipping information and to keep it current.

You are responsible for all activity under your account, including any purchase, token spend or claim made by anyone using your credentials. Keep your password confidential and tell us immediately at info@birdiebros.store if you suspect unauthorized access. One person may hold one account. We may suspend, limit or close an account at any time for suspected fraud, chargeback abuse, multiple accounts, automated play, exploitation of a bug, abuse of staff, or breach of these Terms.

Every physical product we sell is brand-new and factory-sealed. Photographs are representative; packaging designs may vary by production run.

Brand and model names are used solely to identify the balls being sold. BirdieBros is an independent reseller and is not affiliated with, sponsored by, endorsed by or otherwise connected to Titleist, Callaway, TaylorMade, Srixon, Bridgestone or any other manufacturer. All trademarks belong to their owners.

BirdieBros Tokens are a prepaid digital credit that can be used only inside the Services. Tokens are not legal tender or cryptocurrency. They carry no cash value outside the Services, cannot be redeemed for cash, cannot be transferred or sold to another person, and cannot be inherited. The published conversion rate is 100 tokens per US$1.00 of catalog value; we may change the rate for future purchases with notice on the site.

Except where applicable law requires otherwise, token sales and completed token spends are final and we do not offer discretionary cash refunds or cash redemption for tokens. This does not limit remedies for unauthorized payments, duplicate charges, failed transactions or defective products. Damaged or incorrect shipments are handled under our Shipping & Returns policy and applicable law.

Promotional, bonus, referral, daily-reward, level-up and welcome tokens are subject to the eligibility, limits and any expiry stated for the relevant offer, have no separate cash-redemption value, and may be revoked if we determine they were obtained through fraud, duplicate accounts or abuse. If a payment is reversed, charged back or refunded, we may remove the corresponding tokens and any items purchased with them, and may close the account.

We may close inactive accounts with no login for 24 consecutive months after emailing the address on file. Unless applicable unclaimed-property law requires otherwise, unused tokens in a closed account are forfeited.

A completed Box Opening uses a disclosed token price to select a randomized outcome from the box's prize pool, which may include physical prizes or token vouchers. An outcome's listed token value may be less than the opening cost. No particular prize, profit or recovery of your spending is guaranteed, and outcomes are not redeemable for cash. Community Boxes use their own prize pools. Battles distribute prizes according to the selected mode and result; you are not guaranteed to keep your individual pulls or receive a prize from a battle. Availability and legal treatment of these features depend on applicable law.

Results are generated on our servers. The prize is selected by a server-side random draw before any animation begins. Nothing in your browser, device or animation timing changes a committed result. Animations and spin speed are presentation only. Interrupting an animation does not cancel a completed transaction or redraw its result. If a completed result is not visible in your account, contact support so we can investigate the transaction record.

Published odds describe the configured prize pool; displayed percentages may be rounded. Any average return shown is a statistical calculation using the pool's odds and listed token values, not a promised return for you or a cash valuation. Odds, pools, costs and availability may change for future transactions. The server-confirmed price and pool apply to an accepted opening; battles use their committed round sequence. Refresh before confirming if a displayed offer is stale.

If a technical error, pricing error, display error, duplicated transaction or exploit produces a result that does not match the configured odds, inventory or price, we may void the affected opening and credit the tokens used back to your wallet. We may also reverse credits and remove items obtained through an exploit. These corrections do not limit any remedy required by applicable law; an unfavorable but valid random outcome is not itself a technical error.

Physical prizes awarded to you are recorded in your account inventory. Eligible, available items may be claimed for shipment or sold back for 100% of their listed token value. Items already sold back, committed to shipment or otherwise locked cannot be sold back again. Token vouchers credit tokens rather than a shippable product. Out-of-stock outcomes may be credited at their listed token value instead of being made available for shipment. Items are never exchanged for cash.

Shipping claims require the minimum inventory value and fee shown on the claim screen, subject to applicable membership benefits, and a valid deliverable address. Stock is reserved when a shipping claim succeeds, not merely when a prize appears in inventory; a single shipment may contain up to the maximum number of items stated on the claim screen. Once a claim is submitted it cannot ordinarily be cancelled or converted back into tokens; contact support about an error. Nothing in this policy transfers risk of loss earlier than applicable law permits.

Processing and delivery times vary with stock verification, order volume, address checks and carrier conditions; no fixed dispatch or arrival date is guaranteed. Tracking is provided where available. A shipping label alone does not mean the carrier has received the package. Contact us about delayed, missing, damaged or incorrect shipments so we can investigate; any remedy depends on the circumstances, our Shipping & Returns policy and applicable law. Incorrect addresses, refused packages and undeliverable shipments may incur reshipment costs. We currently ship only to addresses we list at checkout.

A listed prize is not a guarantee of indefinite physical stock. If an awarded item cannot be fulfilled, contact support to resolve the affected item under our Shipping & Returns policy and applicable law. We do not guarantee a particular substitute product.

Prices, promotions and availability may change without notice. We may correct obvious pricing or description errors and cancel any affected order with a full refund. Placing an order is an offer to buy; our acceptance occurs when we ship.

Unopened physical merchandise may be returned within 30 days of delivery in its original condition for a refund of the purchase price, less shipping, once we receive and inspect it. Randomized items, opened bulk lots, items shipped from an account inventory claim, and token purchases are not eligible for discretionary change-of-mind returns. These exclusions do not affect rights concerning damaged, incorrect or undelivered products, or other remedies required by law. Contact info@birdiebros.store to start a return.

Subscription memberships renew automatically at the price and interval disclosed at checkout until cancelled. Any renewal price change is subject to required notice and consent. You may cancel through the billing controls in your account; contact support if those controls are unavailable. Cancellation ordinarily takes effect at the end of the paid period. Partial-period fees are not refunded unless required by law. Token allowances and shipping benefits follow the purchased plan's stated rules, limits and billing period; passes are not unlimited shipping. If payment fails or is reversed, benefits may be paused or adjusted.

Users may build and publish Community Boxes and may earn a creator fee up to the published maximum on each opening. Creators must hold all rights to the names, images and descriptions they upload, must not use another party's trademark in a misleading way, and must not use offensive, deceptive or unlawful content. We may review, edit, unpublish, archive or delete Community Boxes at our discretion, with or without notice. Publication does not imply that every submission has been reviewed or endorsed by us. Creator fees are token credits, not guaranteed earnings, and remain subject to the applicable creator and reversal rules.

By submitting content — including box names, descriptions, images, display names, avatars, bios and reviews — you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt and distribute that content in connection with operating and promoting the Services. You are solely responsible for your content. We may remove content and disable accounts for repeat infringement; send copyright notices to info@birdiebros.store.

You agree not to: use bots, scripts, macros, emulators or automation of any kind; attempt to reverse engineer, probe or manipulate the draw, odds, pricing or inventory; create multiple accounts or use another person's payment method; exploit bugs rather than reporting them; resell tokens or accounts; scrape the Services; interfere with or overload our systems; submit profane, hateful, threatening or otherwise offensive content; or use the Services for money laundering, gambling arbitrage or any unlawful purpose. Violation may result in immediate account closure and forfeiture of tokens and unclaimed items, and we may pursue any remedy available at law.

Payments are processed by our third-party payment processor; we do not store your full card details. You authorize us and our processor to charge the payment method you provide for all amounts due, including recurring subscription charges. Prices are shown in US dollars. Review the total shown at checkout, including any taxes and fees displayed there, before authorizing payment. Nothing in these Terms removes either party's obligations under applicable tax law.

Please contact info@birdiebros.store about a payment problem so we can investigate. You do not waive your right to dispute an unauthorized or incorrect charge with your payment provider. A reversed payment may result in adjustment of the linked tokens, items and benefits. We may restrict an account while investigating suspected fraud or payment abuse, subject to applicable law.

The Services are entertainment and should never be used as a source of income or as a way to recover money spent. Set a budget before you buy tokens and stay within it. You may email info@birdiebros.store to request help restricting access or closing your account. A request is not an immediate or automatic block: do not continue purchasing while waiting for confirmation. Do not rely on reminders or account settings as a guaranteed spending-control or self-exclusion system. If play stops feeling fun, stop and reach out for support.

We provide the Services on an as-available basis and may add, change, suspend or discontinue any feature, box, prize pool or price at any time. We may amend these Terms by posting an updated version with a new date; material changes will be announced on the site or by email. Continuing to use the Services after the effective date means you accept the updated Terms.

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any particular result, item or value will be obtained from any opening. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

To the fullest extent permitted by law, BirdieBros and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunity or loss of goodwill, arising out of or relating to the Services, however caused and on any theory of liability. Our total aggregate liability for all claims relating to the Services is limited to the greater of (a) the amount you actually paid us in the 6 months before the event giving rise to the claim, or (b) US$100.

You agree to indemnify and hold harmless BirdieBros and its owners, employees and suppliers from any claim, loss, liability, cost or expense (including reasonable attorneys' fees) arising from your use of the Services, your content, or your breach of these Terms or of any law or third-party right.

Except for small-claims matters and requests for injunctive relief relating to intellectual property, you and BirdieBros agree that any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in the county of our principal place of business or, at your election, by telephone, video or written submission, subject to the Consumer Arbitration Rules and applicable law. Arbitration costs, venue and procedure are governed by those rules; nothing here removes non-waivable access to a court or other statutory remedy.

Before filing, you agree to try to resolve the dispute informally by emailing info@birdiebros.store with a description of the claim and the relief sought, and to allow 30 days for a response, unless doing so would prejudice a statutory right, filing deadline or request for urgent relief. The one-year claim period applies only where lawful and does not shorten a non-waivable statutory deadline.

You and BirdieBros agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and each party waives any right to a jury trial. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — will proceed in court, and the remainder of Sections 15 and 16 stays in force.

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules, and the state and federal courts located in Illinois have exclusive jurisdiction over any matter not subject to arbitration, except where mandatory law provides otherwise. This choice does not deprive consumers of non-waivable protections under the law that applies to them. If any provision is held unenforceable, it is limited or severed and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, sale or reorganization. These Terms, together with our Privacy Policy and any feature-specific rules displayed in the Services, are the entire agreement between us. Sections 3, 9, 10, 13, 14, 15, 16 and 17 survive termination.
